YSL won a public tender for Ron Construction
Wed, 02/25/2009 - 11:02The Supreme Court recently upheld an appeal filed by Ron Construction Works, represented by Adv. Amit Gur and Adv. Lilach Cohen of Yaacov Salomon, Lipschütz & Co., and annulled a decision awarding a tender, in the amount of more than 8 million NIS, for the execution of infrastructure works in the city of Afula, to another bidder. The Supreme Court awarded the tender to Ron Construction Works. Incidentally, the Supreme Court determined that a request made by the Tender Committee for the increasing of a bank guarantee, when the winning bid was not yet selected, constitutes forbidden negotiations during the tender process, which results in the disqualification of the bid made by the bidder with whom such forbidden negotiations were conducted. In its decision, the Supreme Court has also specified the criteria by which unlawful trickery and shifting of prices, on the part of a bidder in a tender process, shall be defined.
